Access to the website https://www.barovier.com/zh (hereinafter also the "Site") and the use of its contents and functionalities are governed by the provisions of the following general conditions of use (hereinafter the "Terms and Conditions of Use").

Access to and browsing of the Site and the use of its features by the user of the Site (hereinafter the "User") implies acceptance of these Terms and Conditions of Use. It follows that Users may browse the Site only in accordance with these Terms and Conditions of Use.

Reference to the Site in these Terms and Conditions of Use shall also include all Barovier&Toso social media sites and/or profiles, including Facebook, Instagram, Pinterest, and any other Barovier&Toso sites or services.

If the User does not wish to be bound by or to accept these Terms and Conditions of Use, he or she must refrain from accessing the Site and using its functions.

1. USE OF THE SITE

The Site is an online information portal, and for certain categories of Users provides access to particular services. Within the Site, all Users may inquire about the products, services and initiatives offered by Barovier&Toso, directly or through parent companies, subsidiaries, companies under common control or associated companies, as well as, occasionally, by third parties in collaboration with Barovier&Toso (e.g. authorised distributors). Certain categories of Users in possession of the necessary requirements and credentials may access reserved areas of the Site to obtain specific online services from Barovier&Toso, governed not only by these Terms and Conditions of Use, but also by the terms and conditions applicable to each specific service.

At any rate, it is acknowledged that nothing on the Site is meant to serve as advice of any kind.

By accessing the Site, the User agrees not to use it, its services or the content made available by Barovier&Toso through the Site for any illegal purposes or for purposes contrary to these Terms and Conditions of Use or in ways that could damage the functionality of the Site.

2. INTELLECTUAL PROPERTY

The Site, the domain name www.barovier.com, the contents on the Site (such as texts, software, databases, animations, photographs, illustrations, sounds, graphic identities, schemes, logos, designs and models, products, hereinafter "Contents") and the trade name "Barovier&Toso", are the exclusive property of Barovier&Toso and/or its assignors, and are protected by current legislation on the protection of intellectual and industrial property rights.

Barovier&Toso alone is entitled to use the aforementioned intellectual property rights on the Site and Content. The use of all or part of the Site and/or the Content, in particular by download, reproduction, transmission, representation or dissemination, for purposes other than personal and private use by the User, is strictly prohibited. Infringement of Barovier&Toso's intellectual property rights relating to the Site and the Content shall entitle Barovier&Toso to take legal action in defence of its interests in relation to the same.

When a User uses the "Share" feature on the Site to introduce Barovier&Toso products, events or communications to others, the User understands and agrees that the Content made available for sharing may only be used for strictly personal purposes, excluding any commercial use on websites, internet pages, or any other digital medium for commercial purposes, unless a written agreement has been reached between Barovier&Toso and the interested party.

For any content the User submits to Barovier&Toso, the User grants Barovier&Toso the unrestricted right to use, reproduce, copy, modify, delete in whole or in part, adapt, publish, translate and create derivative works from such content. The User also grants Barovier&Toso the unrestricted right to licence, sublicense, distribute, and/or integrate such content in any way, on any medium, using any technology, anywhere in the world, without the User being able to claim any remuneration or compensation.

The creation of hyperlinks to the Site can only take place with the prior written authorisation of Barovier&Toso, which can be revoked at any time.

All internet sites that integrate a hyperlink to the Site are not under the control of Barovier&Toso and the latter therefore declines all responsibility (especially editorial) regarding access to such sites and their contents.

Barovier&Toso is free to change the Content of the Site at any time and without notice.

3. LIMITATION OF LIABILITY

The Site is provided "as is" when the User connects and views its Contents.

Barovier&Toso ensures, to the best of its ability, that the information in the catalogues and on the Site are at all times realistic and up to date. However, the User accepts that Barovier&Toso cannot be held responsible for omissions or errors that may be present in the Content. In any instance, Barovier&Toso disclaims any liability for any damages, claims or expenses of any kind resulting from the use of the Site and its Contents, and makes no guarantees in this regard.

Barovier&Toso declines all liability in the event of interruption or inaccessibility of the Site, the occurrence of computer bugs, as well as any damage caused by fraudulent acts attributable to third parties (such as, but not limited to, an intrusion) committed from the Site. Barovier&Toso maintains the right, at its sole discretion, to close the Site and/or make modifications and/or additions to the Content at any time, without giving prior notice and without being obligated to indemnify.

The User is aware that the descriptions and illustrations in the catalogues and on the Site must be understood as merely indicative and for information purposes and cannot be considered binding for Barovier&Toso. This is on account of to the originality, uniqueness and unrepeatability of the company's products. A specific product depicted by the identical photographs may, in reality, vary in terms of size and colour. For instance, this may be due to the User's chosen web browser and monitor settings used to access the Site, which may alter how the images are displayed.

4. QUALITY CERTIFICATE

Since the User is aware of the history and manufacturing processes of Barovier&Toso products, he or she acknowledges that each one is handmade from Venetian crystal by the master glassmakers of Barovier&Toso in Murano and is a one-of-a-kind work of art because it still bears the artistry of the master glassmaker who made it. Therefore, the User is aware that each product is unique and unrepeatable and is absolutely not reproducible in a serial manner. The User thus accepts that the possible differences between different pieces of the same product are not faults or defects, but constitute, rather, signs of particular value and authenticity, an expression of the individuality and beauty of unrepeatable works of art.

5. SITE RESERVED AREAS

This Site may include areas reserved for Users in possession of login credentials, such as username and password (hereinafter the "Credentials"). The Credentials will allow the User to access a personal, non-transferable and non-shareable account, through which he or she can download some confidential materials owned by Barovier&Toso. If the User is a company, it acknowledges that the account will be created to a natural person with suitable powers to bind the company itself.

By controlling access to their terminal (computers and other devices) and agreeing, to the extent permitted by applicable legal provisions, to be held responsible for all activities carried out using the Credentials, the User must keep the Credentials confidential and prevent access to the relevant area reserved by unauthorised third parties. The User undertakes to inform Barovier&Toso immediately in the event that he or she has reason to believe that any third party is aware of his or her password, or in the event that his or her password is, or presumably is about to be, used in an unauthorised manner.

The User also agrees to guarantee the accuracy and truthfulness of the data provided along with the Credentials and to take all necessary steps to notify Barovier&Toso promptly of any changes or variations to said data, as well as to any and all other information that may be provided to Barovier&Toso as a result of using the Site. Changes and variations may be communicated to Barovier&Toso by email at: press@barovier.com. Otherwise, by accessing the Reserved Area section of the Site, Users can access and update the information provided as well as their Credentials directly and, if they so wish, can optionally choose to delete their account by following the procedure indicated therein.

Barovier&Toso may add additional features to the account that will be notified through the Site and/or by email to the User.

6. PERSONAL DATA AND COOKIES

All personal data of the User provided directly and/or indirectly through the Site and its functionalities are processed by Barovier&Toso in compliance with current legislation on the protection of personal data.

If the User uses the forms on the Site to provide personal data, it is assumed that such data are true, correct, relevant and up to date.

For all the information relating to the processing of personal data and cookies by Barovier&Toso, the User can consult the pages of the Site dedicated to the Privacy Policy and the Cookie Policy.

7. CHANGES

Barovier&Toso informs its Users that these Terms and Conditions of Use may be modified at any time. The aforementioned changes apply from the moment they are published online and are considered fully and completely accepted by the User when he or she accesses the Site after their online publication. Barovier&Toso therefore recommends that Users consult this page regularly.

8. LINKS TO THIRD-PARTY SITES

The Site may contain links to third-party sites, pages and applications. Barovier&Toso does not guarantee or assume any responsibility for the operation of these links, their functionality and/or their content, even when this is attributable, in whole or in part, to Barovier&Toso.

With particular reference to, among other things, the opinions expressed in such third-party sites, pages and applications, even if they make use, in whole or in part, of content related to Barovier&Toso, any links to third-party sites and references to information, products or services of third parties linked to the Site do not represent, or cannot be interpreted in any way, as an endorsement or affiliation of the same by Barovier&Toso.

Access by the User through hyperlinks on the Site to third-party sites, pages or applications is subject to all the terms and conditions indicated on said third-party sites.

9. INTEGRITY

In the event that one of the clauses of these Terms and Conditions of Use is declared null and void due to a change in the applicable laws or regulations or following the decision of a court, this will not affect in any way the validity and the obligation to comply with the other clauses of the Terms and Conditions of Use.

10. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Use have been drawn up in accordance with, and are regulated by, Italian law.

Any dispute arising between Barovier&Toso and the User relating to these Terms and Conditions of Use will fall under the exclusive jurisdiction of the court of Venice, Italy.

11. LANGUAGE

Translations of these Terms and Conditions of Use into languages other than Italian are considered courtesy translations. The Italian version of these Terms and Conditions of Use prevails over any version thereof available in a language other than Italian.
